OpenAI is stepping back from NDAs for data center projects

AnnouncementPolicyNov 6, 2026

OpenAI announced it will no longer use non-disclosure agreements with public officials on data center projects, allowing only narrow protections for security information, trade secrets, or competitively sensitive information. The ChatGPT maker also committed to paying the full cost of electricity and infrastructure it uses, publishing expected job creation, and reporting on hiring. Each future "compute campus" will include a local compact reflecting local priorities. Amazon made a similar NDA commitment in October.
